As Akdeniz Yachting attach great importance to the protection of your privacy. Personal data obtained during visits to our websites are processed by us in accordance with legal provisions. Through this privacy policy we would like to inform you about our security measures.

1- SUPERVISOR

As used in the General Data Protection Regulation (“GPDR”) or other applicable laws, the controller is the relevant Akdeniz Yachting company as specified in the legal details of the website.

2- PERSONAL DATA

Personal data includes any information relating to an identified or identifiable natural person; the term “identifiable” refers to any natural person who can be identified, directly or indirectly, in particular by a name, an identification number, location data, an online identifier or by one or more specific characteristics that may reveal the physical, physiological, genetic, genetic, psychological, economic, cultural or social identity of that natural person. Your personal data is collected only when you provide it to us through registration, filling in forms or e-mails, within the scope of orders for products and services, inquiries or requests about the products ordered, and in similar situations where you choose to provide us with information. The database and its contents are kept in Akdeniz Yachting or in data processors and servers representing us and responsible to us. We will retain control and responsibility over the use of any personal data you provide to us. Some of this data may be stored or processed on computers located in other jurisdictions, such as the United States of America, whose data protection laws may differ from those of your jurisdiction of residence. In such cases, we will ensure that appropriate safeguards are in place to require the data processor in that country to have data protections equivalent to those used in your country of residence.

3- COLLECTION AND PROCESSING OF PERSONAL DATA – LEGAL BASIS

You can use our website without declaring your personal data. You are not required to share your personal data in order to use our website, except in cases where a product or service is offered to you upon your request or you need to contact our website. How we collect, process and use your personal data on our website is explained below:

a) The importance of data when you visit our website  : When you use our website, data processing may occur for security reasons, such as communicating with our website or preventing incorrect access, troubleshooting or testing. Among the data we collect; the name of your internet provider, the website you use the link to when accessing our website, the date and time of your visit, the websites you visit via a link through our website and your IP address may also be included. This processing procedure is necessary for us to provide our services or based on our legitimate interests in the provision of communication. Since the website cannot be displayed without this communication, it is assumed that this procedure is also in your interests. These data are deleted at the end of a single session, except in cases where the data must be stored for a longer period of time for investigation and documentation processes due to a security incident.

b) Data shared when opening a customer account When you open a customer account on our website, the personal data you provide (e.g. name, address, e-mail address, telephone, title and access data) will be stored and processed in the Akdeniz Yachting customer database. This data is processed in order to comply with the contract or to take pre-contractual measures. You can deactivate your customer account at any time and/or object to the further storage or use of your personal data for this purpose at any time without specifying any reason, for future implementation, by contacting the contact address specified below. In the event of an objection, your personal data will be deleted immediately. If the customer account is deactivated, your customer account will also be deleted.

c) If you contact us via the contact form or e-mail : If you contact us (e.g. via contact form or e-mail), the personal data you provide to us in the contact form will be stored and processed by Akdeniz Yachting. Which data will be collected if you contact us can be seen in the relevant contact form. This data is stored and used solely for the purpose of responding to your request and/or for communication and related technical administration. The processing of this data is carried out for the fulfilment of a contract or pre-contractual measures, or because the processing of these requests is in our legitimate interests, as well as our legitimate interests, insofar as the data processing is not more important than your interests in the conflict of interest arising in this sense. After completion of the processing of the request, the contact data will only be stored to the extent required by law, statutory retention periods or limitation laws, or for as long as longer storage is necessary to assert, exercise or defend legal claims.

d) Newsletter registration data : If you sign up for our newsletter, your personal data (e.g. name, address and e-mail address) will be stored and processed by Akdeniz Yachting for marketing, advertising and promotional purposes. The processing of this data is subject to your consent or for the execution of a contract. In these cases, you will be regularly sent promotional information about services and products related to Akdeniz Yachting products, services, offers or events. You may unsubscribe from receiving such newsletters at any time without giving any reason for future application by contacting the contact address specified below or by cancelling the subscription through the unsubscribe option specified in the newsletter. As soon as you unsubscribe, your email address will be immediately deleted from our newsletter distribution list, except for a copy of it in the opt-out database, which we assume as part of our legitimate interests to ensure that we no longer send you newsletters.

e) Declaration : Your personal information may be disclosed to third parties to enforce or apply this Privacy Policy and other agreements or to protect the rights, property or safety of Akdeniz Yachting, our customers or others. This includes exchanging information with other companies and organisations for fraud protection and credit risk reduction, or to process payments for products ordered by a banking institution through a payment point offered in our online shop. 4- USE OF COOKIES

Participation in user surveys conducted from time to time on our website is voluntary. Functional cookies are used to carry out user surveys. The technical information recorded by user surveys is the same as that recorded when users visit the website (see above). The answers you provide during the user survey are not mapped to your personal data, such as your IP address.

5- THIRD PARTY SERVICES OR CONTENT ON OUR WEBSITE

Our website offers third party services and/or content. When you use third party services or view third party content, communication data is exchanged between you and the relevant provider for technical reasons. The privacy practices of third party websites may differ from those of Akdeniz Yachting. Therefore, Akdeniz Yachting does not endorse or represent third party websites. Before sharing any personal data with these websites, please check their policies. The respective providers of services or content may also process your data for different purposes. To the best of our knowledge, the services and contents of the providers known to process data for their own purposes are set to be closed to any communication other than providing their services and contents on our website, or the communication is set to occur only when you actively choose to receive the relevant service. However, since we do not have any control over the data collected and processed by third parties, we are not in a position to provide binding information on the scope and purpose of such processing of your data.

a) Website links: Our website may contain links to and from our partner networks, vendors, affiliates and other third parties. If these links are accessed, you will be automatically logged out of the Akdeniz Yachting website. Akdeniz Yachting does not control the websites or privacy practices of third parties that administer these websites. b) Social plugins : Akdeniz Yachting uses services called social plugins (‘buttons’) of social networks such as Facebook, Google+, LinkedIn and Twitter. When you visit our website, these buttons are disabled by default, meaning that no data is transmitted to the relevant social networks unless you interact with them. Before using these buttons, you must activate them by clicking on them. Once you click on these buttons, they will remain active until you deactivate them or delete your cookies (see ‘Cookies’).

Once activated, a direct connection to the server of the respective social network is established. The content of the button is transferred directly from the social network to your browser and is contained within the web page. Once a button is activated, the social network can collect data independently, whether or not you interact with the button. If you are logged in to a social network, the social network can associate your visit to our website with your user account. Unless you activate the button on the relevant page, social networks cannot associate your visits to other Akdeniz Yachting websites with your user account. 6- THIRD PARTY DATA PROCESSORS

No personal data is shared with third parties unless it is necessary for the implementation of the contract, permitted by the relevant legal provisions or with your consent. With this; Akdeniz Yachting may contract with other companies or individuals (“Processors”) to perform certain tasks on our behalf. In this case, we may need to provide Processors with access to personal data. Our processors are obliged to protect the confidentiality of personal data and are prohibited from using this information for purposes other than those defined by Akdeniz Yachting. Examples of tasks performed by processors include; Examples include technical tasks of business partners or subcontractors, payment and delivery services, credit risk reduction and fraud protection, providing analysis services, providing search information or intra-group processing. These Processors only have access to personal data that is necessary to perform the relevant activity. These Processors are specifically prohibited from processing or using your personal data for other purposes. Necessary measures are taken by contract or other methods to ensure that the personal data we declare to our processors is adequately protected and that the Processors have adequate legal, institutional and technical procedures to protect personal data within the scope of current data protection law.

7- SECURITY 

Akdeniz Yachting; It is a global organization with cross-border legal entities, business processes, management structures and technical systems. Therefore, our privacy practices are designed to protect personal data obtained worldwide. According to Akdeniz Yachting policies; Access to personal data is provided only to authorized employees, representatives, contractors, legal entities and Processors who Akdeniz Yachting determines have the right to view or access the information for legitimate reasons in order to fulfill their responsibilities. Akdeniz Yachting; uses technical and organizational security measures to protect the data you provide and we manage against manipulation, loss, destruction and access by third parties. Our security measures are constantly improved in line with advances in technology. Where we have given you (or where you have chosen) a password which enables you to access certain parts of our website, you are responsible for keeping this password confidential. We kindly request that you do not share such passwords with anyone.

8- DATA STORAGE 

Unless specific storage periods are stated above, the following general rules will apply: Your data will be deleted as soon as it is no longer necessary for the purpose of use, or if you withdraw your consent, or if you object to its use based on legitimate interests and we have no legitimate right of cancellation against this objection. In some cases; Longer retention periods may apply if we are obliged to do so by law (e.g. under tax and commercial law) or if the data is necessary for the establishment, exercise or defense of legal claims.

2. to request the correction, removal or restriction of your personal data for certain reasons; e.g. (i) the data is incomplete or inaccurate, (ii) the data is no longer necessary for the purposes for which it was collected or (iii) the consent to data processing has been withdrawn

3. not to give consent for the processing of your personal data at any time and to withdraw the consent you have given – without affecting the processing activities that took place before the withdrawal

4. take legal action and lodge a complaint with the competent data protection authorities regarding a potential infringement of your rights regarding the processing of your personal data;

5. Request (i) the transmission and reuse of the personal data you have provided to us and held about you in an organized, commonly used and machine-readable format and (ii) the transfer of this data to another controller without hindrance from us you have the right to have personal data transferred directly by us to another controller, where technically feasible. 

10 – RIGHT OF OBJECTION

You may have the right to exercise your right to object if it is related to your particular situation and your personal data is being processed. In this case, please inform us about your specific situation. As a result of the evaluation of the elements you provide, the processing of your personal data may be stopped or we will provide you with compelling legitimate grounds for a continuing transaction. We reserve the right to update and change this Privacy Policy from time to time to reflect changes in the way we use your personal data or in legal requirements. If changes are made, the amended Privacy Policy will be published on our website.
